First Time Haven scammed on an excursion

We have taken approximately 10 cruises with NCL and refer them to everyone that asks us about cruising. We found a sale on the Haven and decided to try it out. The boarding process was pretty easy and when we arrived to the room I was not happy with the fact that the room was not actually in the Haven but 3 floors below it was only a “Haven room” so be aware where your room is compared to the actual Haven when booking. The room was about twice the size of a standard balcony room and was very well appointed. The room attendant was spot on and always available if we needed anything. The Haven itself was very nice and clean, with adequate staff.

We did an excursion in Cozumel to the Exclusive Cozumel beach day resort. They stated it is a 5 star resort Iberostar of Cozumel that was all inclusive for 169 ea.. We arrived to the resort and the lobby was nice. We immediately went to the only open buffet. It was the standard buffet mostly fruit and finger foods with a few foods I was unfamiliar with. After finding food we walked out to the beach. I was shocked at how murky the water was. It was completely brown all of the way out to the buoys. There was a dock out to the right that had dive boats coming and going, so going out past the buoys was not an option. The other water sports advertised were nowhere to be found. It was very hot and humid so we hung out in the pool for awhile then went to the lobby to wait for the bus. Not one person was in the ocean. I looked into the advertised photo that NCL has online and its a stock photo from the internet and definitely not of the “resort”. This was the last day of the cruise And I mentioned it to the concierge who reported it to the excursion desk. Late that evening we received a phone call from a lady at the excursion desk stating that we were crazy and that it was a 5 star resort by Cozumel standards and we had no right to complain about it. We couldn’t follow up because we were getting off the ship the next morning. We did try and get a refund later and they gave us 53 of the 338 that it cost and stated they had no record of the complaint. I think its wrong when they falsely advertise something even using a stock photo from the internet that isn’t even from the resort.
